Agreement to these terms
These Terms of Service are an agreement between you and Unleashed Worldwide, a Delaware company. By accessing or using Unleashed, you agree to these terms and to our Privacy Policy.
If you use Unleashed on behalf of a school, district, company, or other organization, you represent that you have authority to bind that organization and authorize use by its users.
The service
Unleashed helps authorized educators turn educator-provided materials into reviewable, accessible, adaptive learning experiences. Generated content is intended to support teachers and schools, not replace professional judgment, required review, or institution policy.
Unleashed does not provide medical, psychological, legal, or disability determinations and does not infer diagnoses or hidden learner labels.
Accounts and authorized users
- You must provide accurate account information and keep credentials secure.
- Teachers, schools, districts, and administrators are responsible for assigning roles and granting access only to authorized users.
- Students may use Unleashed only through an authorized school, district, teacher, parent, guardian, or other permitted arrangement.
- If students under 13 use Unleashed, the school, teacher, district, parent, guardian, or other authorized representative is responsible for providing any consent required by law where permitted.
Acceptable use
You may use Unleashed only for lawful educational, instructional, administrative, or evaluation purposes connected to the service.
- Do not upload content you do not have the right to use.
- Do not attempt to bypass security, access another user's account, scrape the service, disrupt the service, or introduce malware.
- Do not use Unleashed to harass, harm, profile, discriminate against, or make legal, medical, psychological, or disability determinations about any person.
- Do not submit unlawful, infringing, deceptive, harmful, or non-educational content.
- Do not use Unleashed to train third-party AI models or build a competing service without our written permission.
Your content and permissions
You keep ownership of curriculum, files, student work, responses, and other content you submit to Unleashed. You are responsible for having the rights and permissions needed to submit that content.
You grant Unleashed a limited permission to host, process, display, transform, analyze, and use submitted content as needed to provide, secure, support, and improve the service, including AI generation using uploaded educator materials, teacher review, student delivery, audit trails, and support workflows.
We do not sell your content and do not use uploaded curriculum, student work, learner model data, or IEP content to train third-party AI models.
Generated content and educator review
AI-assisted content may be incomplete, inaccurate, or unsuitable for a particular class or student. Teachers or authorized staff are responsible for reviewing generated content before publishing when review is required and for deciding how to use the service in instruction.
Unleashed does not guarantee that generated content is complete, accurate, or suitable for every instructional use. It also does not guarantee any particular learning outcome, assessment result, retention result, or compliance result.
Subscriptions, pilots, and billing
Some plans may be free, trial-based, paid, or institution-specific. Plan limits, pricing, renewal, cancellation, and procurement details may be shown in the product or governed by a separate written agreement.
If paid billing is enabled for your account, you agree to provide accurate billing information and pay applicable charges. Taxes, refunds, renewals, and cancellations are handled according to the plan terms shown at purchase or in a separate agreement.
Unleashed intellectual property
Unleashed, including our software, interface, workflows, brand, documentation, and non-user content, is owned by Unleashed Worldwide or its licensors. These terms do not transfer ownership of Unleashed intellectual property to you.
Subject to these terms, we grant you a limited, revocable, non-exclusive, non-transferable right to access and use Unleashed for authorized purposes.
Copyright concerns
If you believe content in Unleashed infringes your copyright, contact support@unleashedlms.com with your name, contact information, a description of the copyrighted work, the location of the allegedly infringing material, a good-faith statement, and a statement that the information is accurate and that you are authorized to act for the copyright owner.
Third-party services
Unleashed uses third-party services for functions such as authentication, uploads, analytics, AI processing, database hosting, and hosting infrastructure. These providers may process information as described in the Privacy Policy.
Third-party services are not controlled by Unleashed, and their terms and policies may apply to their services.
Suspension and termination
We may suspend or terminate access if we believe there is a security risk, unlawful use, violation of these terms, nonpayment, misuse of student data, or a request from an authorized school, district, or account administrator.
You may stop using Unleashed at any time. Data return, deletion, or export may depend on your role, institution agreement, legal requirements, and the Privacy Policy.
Disclaimers and limitation of liability
Unleashed is provided on an as-is and as-available basis to the fullest extent permitted by law. We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
To the fullest extent permitted by law, Unleashed Worldwide and its suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, interruption, or substitute services. Our total liability for claims relating to the service is limited to the amount paid to Unleashed for the service giving rise to the claim during the 12 months before the event, or 100 U.S. dollars if no amount was paid.
Governing law and venue
These terms are governed by the laws of Delaware, without regard to conflict-of-law rules. The state and federal courts located in Delaware will have exclusive jurisdiction and venue for disputes arising from or relating to these terms or Unleashed, except where a separate written agreement says otherwise.
Changes and contact
We may update these terms as Unleashed changes. If changes are material, we will provide notice appropriate to the change. Continued use after the effective date means you accept the updated terms.
